As a Senior Legal Counsel, you will be responsible to implement global strategy and advise management and business on legal and integrity issues relating to the relevant area(s) of responsibility to ensure full compliance with Group directives and instructions, as well as local legal regulations.
Your tasks as a Senior Legal Counsel will include the following :
Application of principles of construction contracts and commercial law to practical situations within the manufacturing or construction industry.
Drafting of contracts including clear understanding of terms and conditions.
Risk identification, evaluation, assessment and mitigation in the contractual context.
Balancing opportunity as against risks.
Drafting of letters of demand, internal advisory memorandum and similar types of documents.
Working with ABB General Counsel, South Africa on assisting with instructing external counsel when required, providing relevant information and managing their fees.
Attending, holding and leading meetings with internal clients, customers, external counsel and other stakeholders.
Strong and flexible negotiation skills are a must.
Ability and experience in delivering seminars and training sessions in contract issues will be a bonus.
Additional knowledge or experience in compliance and integrity issues will be valuable. For example, integrity training, handling conflicts of issues and advising on anti-
corruption and competition laws.
Excellent communication, presentation and time management skills.
Ability to effectively and constructively negotiate with a wide variety of internal and external stakeholders and across cultural and national differences is a must.
Self-motivated and dynamic, and be willing to work in a team or independently as the circumstances require.
You should have a strong personality but is able to be flexible and be able to listen fairly and objectively to others views while maintaining the company (and the individual’s) integrity and value system.
Minimum qualification is an LLB degree from a South African university.
Legal qualifications particularly in areas like tax, insurance, contract law.
Minimum 8 years post-articles practical experience at a reputable law firm or at reputable companies with experience in construction contracts like NEC, Fidic and bespoke agreements.
Qualified and admitted Attorney of the High Court of South Africa.
Practical experience in advising on construction contract interpretation, assessment of impact on project from contract perspective, preparation of legal letters, claims, disputes, etc.
both in relation to customer and suppliers.
Experience in working with project team and a wide variety of differentially skilled professionals (engineers, project managers, site managers, quantity surveyors, HSE officers, quality experts, other managers and employees).
Support all business units within the Industrial Automation division as well as other legal activities (group functions, supporting other divisions from time to time depending on the need).
