Context :

The Head of Legal - Marketing is responsible for managing the legal risks and opportunities associated with Anglo American’s global marketing operations (excluding DeBeers)

Purpose :

The role holder is responsible for supporting the management of legal risks and opportunities associated with Anglo American’s marketing business (excluding De Beers) originating in the South African office

Typical Tasks :

Specialist Legal Support :

  • Support the success of Anglo American providing a wide range of legal advice to Anglo American’s marketing business (excluding De Beers)
  • Identify key legal risks and opportunities associated with the marketing business’s activities, including day to day trading queries (physical and paper), disputes, projects and origination transactions
  • Report on a regular and consistent basis in relation to progress of work, costs and legal matters
  • Update the Group Legal reports comprehensively and accurately as-and-when material developments occur or monthly, whichever is the more frequent.
  • Where required, participate in briefings of General Counsel, Deputy Head of Legal South Africa, BU management and other stakeholders

  • Work closely with the business teams to provide timely and appropriate advice in connection with commercial transactions, projects and strategy developments
  • Support the compliance and risk teams to provide effective operational compliance oversight and monitoring
  • Manage the provision of legal services by external lawyers and law firms in a cost-effective manner
  • Work with the Head of Legal : Marketing, collaborate to develop processes, procedures and strategies for managing legal risk in relation to marketing legal risk
  • Working with the Head of Legal : Marketing, collaborate to develop playbooks and processes for optimising Group Legal’s delivery in relation to the Anglo American Group’s marketing business legal activities
  • Manage client relationships to deliver high quality / timely advice to the Anglo American Group in relation to its marketing business legal activities
  • Support the success of Anglo American in providing legal support to the Anglo American Group wherever it is required to the extent that the legal work required falls within the role holder’s fields of professional competence :

    Identify key legal risks and opportunities.

  • Report to client on a regular and consistent basis in relation to progress, costs and issues arising and obtain approval for material decisions in all matters in which the role holder is the lead lawyer.
  • Update the Group Legal reports comprehensively and accurately as-and-when material developments occur or monthly, whichever is the more frequent.

    Where required, participate in briefings of General Counsel, BU management and other stakeholders

  • Manage provision of internal and external legal services and provide legal advice in a cost-effective manner

  • Financial :

  • Identify any opportunities for improved cost management and either address these, or raise them with your manager as appropriate
  • Develop, monitor and manage the budget for your area
  • Formal Qualification :

  • Admitted as an attorney in South Africa
  • Role Specific Knowledge :

  • Experience of international commodity trading (physical and paper) preferably gained in-house within a large multinational commodities company
  • Would be preferable to have experience in drafting and negotiating international commodity sales contracts in bulks, precious metals and LME products (Incoterms, SCoTA, SIOTA), including shipping terms for bulks and containerised vessels
  • Knowledge of competition, compliance and sanctions issues in commodity contracts
  • In-depth understanding of identifying and mitigating risk
  • Commercial awareness and pragmatism
  • Excellent understanding of South Africa law.
  • Dispute resolution. Understanding of English Law would be an advantage.
  • Experience of working for a global business with operations in diverse locations would be an advantage
  • Commercial understanding of consequences of legal risk and scenarios
  • Other requirements to perform the work effectively :

  • Qualified as a legal practitioner in any one or more of the jurisdictions in which the Anglo American Group has operations or does business
  • Experience in a major international or regional law firm or as an in-house lawyer in a multinational
  • Proof of professional registration and qualifications
  • Medical fitness assessment no older than two years
  • Owing to the particular ethical considerations relating to legal service provision, the Head of Legal : Marketing may from time to time require lawyers to furnish the department with a credit report, data relating to business ownership, interests and directorships and / or a police clearance certificate
