  • To lead the Personal Account (PA) Trading Control function by developing and guiding the implementation of the PAT Control Framework across all jurisdictions in which the business operates to ensure the appropriate conduct of employees when conducting personal account trading as required by applicable regulatory requirements and therefore avoiding potential operational losses, fines, penalties or reputational damage to the organisation and enables the competitive advantage of the organisation.
  • Key Responsibilities / Accountabilities Risk, Regulatory, Prudential & Compliance

  • Keep abreast of and analyse legislative developments, particularly in relation to local and international standard bodies, in order to effectively lead the function's operations, understand the legal implications for the organisation and deliver expert advice to the organisation with regard to relevant legislation.
  • Provide input and support to the Head, Compliance in preparing formal responses on behalf of Standard Bank Group to requests from Regulators and Supervisors.
  • Drive the creation, embedment and implementation of systems and processes within the function that will ensure the effective and proactive identification, analysis, review and reporting of PA Trading risks and non-compliance.
  • Set and advise on best practice processes and systems for business areas and the PA Trading Control function to effectively monitor and control adherence, conformance and compliance to PA Trading policies and standards across all jurisdictions as per the Framework in order to ensure compliance with relevant statutory and regulatory laws.
  • Produce consolidated, holistic and reliable reports to relevant forums, committees and stakeholders in relation to legislative and Risk Management requirements and formulate pertinent observations, statistics and trends to enable the effectiveness of critical business decisions.
  • Provide specialised advice to Senior Stakeholders across the organisation on required minimum standards, strategies, projects, plans, initiatives, reporting and other relevant activities as set out by the Functional Framework to ensure all business areas effectively comply with internal standards and legislative requirements.
  • Review and take action based on information provided by Direct and Indirect reports, regarding matters such as statistics, dashboards, reports, risks, escalations, technology and system issues.
  • Drive or participate in Risk Management oversight committees and forums relevant to PA Trading matters, in order to monitor the implementation of the Framework across the organisation.
  • Remain proficient and knowledgeable about best practices required in leading a PA Trading Control function and provide the necessary recommendations for adaptation and improvement to the framework.
  • Provide input and support to the Line Manager to ensure high quality reporting and assurance to the relevant Boards, Executive Management, Audit Committees and other relevant forums.
  • Provide advice and information to the Audit and Monitoring Functions, when requested, to enable their ability to provide the required level of assurance and therefore guide effective risk management decision making.
  • Drive the delivery of all objectives, projects and automation initiatives for the PA Trading Control Function to ensure the function remains aligned to international best practice.
  • Pre-approve third party trading accounts of employees and impose PA Trading restrictions to ensure compliance with internal policies and regulatory requirements.
  • Manage the execution of the PA Trading Control Desk operations and guide the management of breaches and non-compliance issues.
  • Conduct investigations on complex deals and transactions in order to identify non-compliance with internal policies and regulatory requirements.
  • Client

  • Provide expert advice and guidance to stakeholders and clients (Trusted Advisor). Resolve queries regarding the analysis, information and reports.
  • Where necessary provide training to targeted business areas. Engage in the appropriate forums and workshops to convey analysis findings to wider audiences when required.

    Data

  • Oversee and advise on the collection and capturing of data relevant to regulatory requirements to ensure the information is reliable and therefore will effectively guide critical business decisions.
  • Financial Management

  • Monitor and control cost in-line with the functions budget by ensuring sound financial practices.
  • Strategy

  • Develop, maintain and implement the PA Trading Control Framework - covering strategy, policy, process, procedures, standards, guidelines, training, objectives, metrics and governance - to ensure consistency of implementation and the alignment to the changing regulatory and legislative requirements across all relevant countries / jurisdictions and international best practices and standards.
  • Identify improvements and update the Framework for the function to ensure that sufficient measures are in place to manage current and potential PA Trading risks across all regions / jurisdictions in which the business operates.
  • People

  • Lead the Function according to the lean leadership and employee engagement principles, including employee lifecycle from recruitment through to exit, performance management, training and development, discipline and grievance management, retention and reward and people administration, to ensure a high-performance culture.
  • Build and maintain effective relationships with the relevant regulators and stakeholders on all areas of responsibility.
  • Implement the Functional People plan with support from the Human Capital Function. Identify current and potential employee skill requirements in consultation with the Human Capital Function.
  • Conduct training accurate training and awareness to relevant Compliance and Business Stakeholders to ensure they remain abreast of the required PA Trading conduct as per the regulatory requirements.
  • Provide and oversee the development of accurate and relevant training and awareness material or communication on regulatory or international best practice requirements and changes and manage the implementation of the required training.
  • Technology & Architecture

  • Drive the development and implementation of systems to effectively enable the functions operations.
  • Preferred Qualification and Experience Legal Degree Risk Management Degree Audit Degree 5-7 years Experience - A full understanding banking products and services including investment banking and personal account trading, in order to understand complex trading deals / transactions and therefore identify conflicts of interest.

    8-10 years Experience - The role requires a leader seasoned and expert in Investment Banking related Compliance with profound knowledge of the full dimensions of the field, but deep expertise in Personal Account Trading Risk Management.

    Regulatory environment savvy, a proven track record in influencing seasoned leaders and employees across multiple countries and business areas to effectively implement compliance frameworks.
